These Terms of Use ("Terms") govern access to and use of ARIA services provided by Madd Technologies LLC ("Madd Technologies", "we", "us", or "our").
By using ARIA, you agree to these Terms.
1. Eligibility and Authority
You must be legally able to enter into these Terms. If you use ARIA on behalf of an organization, you represent that you are authorized to bind that organization.
2. Accounts and Credentials
You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account, including actions by authorized users.
3. Service Description
ARIA provides AI-assisted communication and workflow features, including call handling, email drafting, summarization, and scheduling support.
Features may change over time for reliability, security, legal, or product reasons.
4. AI Outputs and User Responsibility
AI outputs may be inaccurate or incomplete. You are responsible for reviewing and approving outputs before use or transmission.
ARIA does not provide legal, medical, tax, accounting, or other regulated professional advice.
5. Billing and Plans
Paid features, usage limits, and billing behavior depend on your selected plan. You are responsible for applicable fees, taxes, and payment obligations unless otherwise agreed in writing.
6. Acceptable Conduct
You must use ARIA lawfully and in compliance with your policies and applicable regulations.
You may not:
- Use ARIA for unlawful, abusive, fraudulent, or deceptive activity
- Attempt unauthorized access, exploit vulnerabilities, or disrupt service operations
- Circumvent safeguards or misuse APIs and automation pathways
- Violate third-party rights, privacy obligations, or consent requirements
7. Communications and Recording Compliance
You are responsible for complying with all applicable call recording, notice, consent, and communication laws when using ARIA call features.
8. Intellectual Property
Madd Technologies and its licensors retain rights in ARIA software, interfaces, and related intellectual property, except as expressly granted.
You retain rights in your content, subject to licenses necessary for us to operate and support the service.
9. Third-Party Services
ARIA may integrate with third-party providers. Your use of those providers is governed by their terms and policies. We are not responsible for third-party availability, acts, or policy changes.
This includes AI providers such as OpenAI. Depending on provider policies and configuration, submitted service data may be retained and may be used for model training or service improvement by that provider.
You acknowledge that provider-side retention and training practices may not be fully controlled by Madd Technologies.
10. Suspension and Termination
We may suspend or terminate access for policy violations, security risk, non-payment, legal requirements, or abuse concerns.
Upon termination, access may be revoked and data may be deleted or retained as required by law or policy.
11. Disclaimers
To the extent permitted by law, ARIA is provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, or non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, Madd Technologies is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.
Aggregate liability is limited to the amounts paid for ARIA under the applicable period and governing law, unless otherwise required by law.
13. Indemnification
You agree to indemnify and hold harmless Madd Technologies from claims arising from misuse of ARIA, policy violations, unlawful processing, or breach of these Terms.
14. Governing Law and Disputes
Unless mandatory law or written contract states otherwise, disputes are governed by the laws of the applicable Madd Technologies jurisdiction.
15. Changes to Terms
We may update these Terms from time to time. Continued use after updates constitutes acceptance where legally permitted.
